The decision was taken when the TNA appeared in court today to show cause as to why the court should not hear the case.
After listening to the submissions made by the TNA, the Supreme Court felt there was enough grounds to go ahead with the case.
A petition had earlier been filed by Dr. Gunadasa Amarasekera and six
others against the manifesto of the TNA at the last provincial council
elections.
The Supreme Court had on September 18 declined to suspend the Northern
Provincial Council election after the petition was filed under Article
157 (4) A of the Constitution claim the TNA manifesto violates the sixth
amendment to the constitution that prohibits any political organisation
from having as one of its aims the creation of a separate state within
Sri Lanka.
The petitions cited ITAK General Secretary Mavai Senathirajah, TNA
Leader R. Sampanthan, Elections Commissioner Mahinda Deshapriya and the
Attorney General as respondents.
