MULANGAVIL: The Presidential Commission on Disappearances and War Crimes (DWC) has asked President Mahinda Rajapaksa to establish an Investigating Team to help it pursue cases of alleged involuntary disappearance in the country.

Talking to a group of news persons at a sitting of the commission in Mulangavil in North West Sri Lanka on Sunday, the panel chairman, Justice Maxwell Paranagama, said that the charge that persons had disappeared after they had surrendered to the army or after crossing army-held territory, needs to be investigated by a competent agency.

“I have put in a request for  such a team to the President, but have not got a response so far,” Paranagama said.

Asked who might head the proposed the Investigating Team, he said that it would not be a police or army man but a retired judge so that no one can complain of a pro-state bias. The team would collect evidence and see if a case is fit for legal action. Giving an example of case in which investigation had been useful, he said that a proper probe in that case had revealed that the person who had allegedly disappeared was living in a refugee camp in Tamil Nadu.

Paranagama clarified that the recommendations of the commission and the investigating team are not binding, and it is the President’s prerogative to accept or reject a recommendation.

The commission has so far received more than 19,000 complaints of involuntary disappearance and has interviewed almost 1,300 affected families. It has had six sittings in the North Eastern Tamil-speaking districts of Batticaloa, Trincomalee and Mullaitivu. It is now conducting four sittings in Kilinochchi district.

Paranagama asserted that his panel is not under any pressure from the government. Despite propaganda about bias, people are coming to place their grievances before it, and people are speaking freely, he said.

Recognising a help and expressing gratitude for it is a worthy human gesture. This applies to groups, societies, or even countries. 

Non recognition of a helping hand given is considered unkind and disgraceful. Worse is when parties unrelated are praised when the true helper is elsewhere unrecognised.  In Sinhalese tradition, such behaviour is deplored, and the expression underlying such an attitude is “Gangen diya bee muhudata aawadiema”, or “praising the sea having drunk water from the river”.

This must be the feeling that came out from His Excellency the High Commissioner of India, Mr Sinha, when he made his chief guest’s speech at the Anagarika Dharmapala Commemoration session organised last week by the Centre for Contemporary Indian Studies of the University of Colombo.  He publicly mentioned in this speech that India has done so much for Sri Lanka, but inadequate expression of gratitude came from the Sri Lankan side, while others were frequently praised. A particular point of reference made in Mr Sinha’s speech was the Yal Devi train going to Jaffna after two and a half decades on the reconstructed Northern Railway tracks using Indian credit facilities.

As Sri Lankans, we should not ignore this as Mr Sinha’s personal opinion as he is the High Commissioner for India, thus more likely be reflecting the official sentiment of India. That is more the reason why we should examine the facts.                                               Read More

Former British Foreign Secretary William Hague said Sri Lanka's refusal to participate in the End Sexual Violence in Conflict summit was an “obvious gap”, adding its rejection of the campaign will become “more and more obvious” in the months ahead.

Speaking at the sidelines of the Conservative Party Conference in Birmingham, Mr Hague hailed the countries who attended the summit in London earlier this year, calling it a “summit like no other”. 

Responding to a question from the Tamil Guardian, Mr Hague said, “Sri Lanka is an obvious gap particularly since so many of these crimes have taken place there, despite all our encouragement to the Government of Sri Lanka.”
155 governments around the world signed up to a declaration at the summit, committing to prevent and punish perpetrators of sexual violence. Sri Lanka though, did not attend the summit and refused to sign the declaration.

“Sri Lanka is a more difficult case, partly because the Sri Lankan government doesn't always want past crimes to be investigated,” added the former Foreign Secretary, who is currently Leader of the House of Commons.

Despite this “Britain has led the way in securing a resolution in the human rights council of the UN calling for an international investigation” said Mr Hague, acknowledging however that “now Sri Lanka isn't co-operating with that.”

Sri Lanka's omission was particularly notable given that other countries in the region had committed to the campaign he added.

“We have India, Burma – Burma! - involved in the PSVI (Preventing Sexual Violence Initiative) campaign. And therefore as the years go by, or the months go by, the omission of Sri Lanka will become more and more obvious.”

British Ministers Hugo Swire and Mark Simmonds previously expressed disappointment at Sri Lanka’s absence, irking the then Acting Sri Lankan High Commissioner Neville de Silva in London who said the criticism was "surely misplaced".

Mr Hague also said the issue had been “taken to media and civil society” groups on the island, recalling his visit to Colombo last year where he spoke on the topic of sexual violence.
“The main public meeting I held, which was broadcast on Sri Lankan television and reported by many papers, was about this subject," he said. "Again it's the impact we can make as Britain going to other countries and this is the thing we are talking about.”

He had earlier reiterated the weight that Britain had thrown behind the campaign, saying “Britain has enormous influence in the world. We have a seat in every table in the world.”

The work for the campaign will continue says Mr Hague, even after he steps down from the House of Commons next year.

“Failure to tackle these issues in the past sows the seeds of conflict in the future... that is the purpose often of mass rape in war. To make it harder for one community to be reconciled with the other.”

“At the heart of so many conflicts we have seen this sickening crime,” he concluded. “Unless we do something about it it will get worse.”

When President Xi Jinping of the People’s Republic of China, visited India, an Indian Doordharshan television newsreader kept referring to the President as “President Eleven Jinping!”

Either the newsreader had an irrepressible sense of humour, or whole episodes of human history that passed that worthy by; she did not know that Latin was no longer the ‘lingua franca’ of the world and ‘Xi’ was pronounced somewhat like ‘Shki’ in English, rather than the numerical 11! Definitely Gibbon’s monumental work ‘The Decline and Fall of the Roman Empire’ was not on that worthy’s school reading list! Doordharshan promptly fired the lady.

Jayalalithaa moves High Court against conviction, seeks bail

BANGALORE: Seeking immediate bail, jailed AIADMKsupremo J Jayalalithaa today moved the Karnataka High Court challenging her conviction in the disproportionate assets case which cost her the chief minister's job and disqualified her from being an MLA.

Noted Supreme Court lawyer Ram Jethmalani is believed to have been drafted by Jayalalitha's legal team for arguing the bail and stay application that is likely to come up for hearing by a vacation bench tomorrow.

In her petition, she has maintained that the charges of amassing wealth against her were false and that she had acquired property through legal means.

Jayalalitha has contended that the trial court has overlooked several judgements and has not considered the binding nature of various income tax orders and decisions of the Income Tax Appellate Tribunal, which had accepted the income and the level of expenditure pleaded by her.

The former chief minister said she had earned money by acting in films and bought property through legal means, Ashokan, Jayalalithaa's lawyer told PTI here.

C Duraipandian, member of the AIADMK legal, team said they have filed an appeal for suspension of the conviction and the sentence and have also refused to pay the Rs.100 crore fine imposed on her.

In a verdict on Saturday at the end of an 18-year old legal battle, Special Judge John Michael D'Cunha had convicted her, sentenced her to four years imprisonment and slapped a staggering fine of Rs 100 crore in the Rs 66.65 crore corruption case.

Unless the conviction is suspended immediately and later overturned by superior courts, Jayalalitha faces a bleak political future as she cannot contest elections for 10 years--four years in jail and six years after that.

Jayalalithaa also denied allegations that she has any share in Jaya Publications and was in no way connected with it.

Her aide Sasikala, her relatives V N Sudhakaran, disowned son of the former Chief Minister, and Ilavarasi have also filed applications in the High Court seeking bail and challenging their conviction.

The high court is on Dasara holidays from September 29 to October 6 and their petitions are also expected to be taken up tomorrow during a scheduled hearing by a vacation bench.

Sasikala, Sudhakaran and Ilavarasi were also convicted and sentenced to four years of jail term and fined Rs 10 crore each in the landmark judgement that saw the first conviction of a sitting Chief Minister in a corruption case.

Jayalalithaa and the other accused were held guilty of amassing wealth disproportionate to their known sources of income under the Prevention of Corruption Act and criminal conspiracy under the Indian Penal Code.

She had been accused of committing the offence when she was the chief minister for the first time during 1991-96.

With the special court giving more than a three-year jail term, Jayalalithaa can hope to get relief only from the High Court. If a stay on conviction is granted, it would nullify the disqualification of Jayalalithaa as MLA.

Jayalalithaa and the other three are at present lodged in the Parappana Agrahara central jail here.

BBS Wimalajothi Misleads People: All Ceylon Jamiyyathul Ulama

The All Ceylon Jamiyyathul Ulama has strongly condemned the information presented by Kirama Wimalajothi thero about the All Ceylon Jamiyyathul Ulama at BBS conference, held at the Sugathadasa Indoor Stadium.

Issuing a statement today the ACJU said; “The venerable thero has misled those present, stating that the All Ceylon Jamiyyathul Ulama is a recently established and extremist organisation.”

The All Ceylon Jamiyyathul Ulama statement opposing the ideas expressed at the Bodu Bala Sena Conference on 2014 .09.28

The Bodu Bala Sena is unrivaled in the history of Sri Lanka in its campaign of insulting other religions and posing a threat to the harmony and peaceful co-existence between the ethnicities. It is extremely hurtful that they would choose to degrade, insult and humiliate Islam, a resplendent religion that teaches the great values of equality, brotherhood, and humanity; with a history of 1500 years and followed with unwavering faith by over 1620 million people worldwide.

The All Ceylon Jamiyyathul Ulama is the apex body that is tasked with providing religious guidance for the Muslims of Sri Lanka. This is an organization with no political affiliations. Established in the year 1924, it has since been engaged in its duties diligently and continuously, and the Muslim community of Sri Lanka carries out its religious and social work under its guidance.Many media outlets reported excerpts of the speech made by the leader of the Bodu Bala Sena, Ven Kirama Wimalajothi Thero on 28 – 09 – 2014 in Colombo at its ‘Mahaa Sanga Samuluwa’ conference. We strongly condemn the false information presented by the venerable thero about the All Ceylon Jamiyyathul Ulama at this conference, held at the Sugathadasa Indoor Stadium and attended by members of the clergy and the lay population. The venerable thero has misled those present, stating that the All Ceylon Jamiyyathul Ulama is a recently established and extremist organization.

The contributions of the All Ceylon Jamiyyathul Ulama to the motherland during the times of conflict in the past, and in the post conflict era are well recorded facts known by all. Labeling this responsible organization that constantly promotes religious coexistence, patience and unity, as an extremist organization by a religious leader, is a grave mistake.

This country has a security apparatus, and an intelligence apparatus. At a time when all these high-level organizations are issuing statements that there is no terror activity among the Muslims of Sri Lanka; we see it as truly amusing that the All Ceylon Jamiyyathul Ulama is being identified as an extremist organization by some elements.

We express our dissatisfaction in the strongest terms, at the expression of racist ideas at this conference held for the purpose of inciting tensions.

We would like to ask Ven. Vimalajothi Thero if he could present any evidence proving the All Ceylon Jamiyyathul Ulama’s involvement in inciting or supporting violence, at any time. We would also like to ask who could deny the fact that, even when the Muslim community was viciously attacked and their shops and properties were set on fire, it was the All Ceylon Jamiyyathul Ulama that urged them to practice patience and responsible behavior. Furthermore, we would like to emphasize that the All Ceylon Jamiyyathul Ulama has been an organization dedicated to peace, harmony and co-existence at all times.

We would like to question what right the venerable thero has, to label the Muslim community’s apex religious organization as an extremist organization. It seems that the venerable thero hoped to incite the Muslim populace by expressing such outrageous ideas, and therein start a new drama. On many previous occasions too, the venerable thero and members of his organization have attempted to prod the All Ceylon Jamiyyathul Ulama. At every such instance we have requested them to refrain from such activities. The venerable thero’s actions are contemptible, and should be rejected with disgust. The venerable thero should change his mind-set and his ways. The All Ceylon Jamiyyathul Ulama would also like to request that the venerable thero withdraw the wrongful statements made by him.

The All Ceylon Jamiyyathul Ulama also deeply condemns the attempts made at this conference to label organizations such as the Muslim Council and the Shoorah Council, which are engaged in community development and social work, as extremist organizations. We strongly denounce the actions of Ven. Galagodaatte Gnanasara Thera, who, with the immature intention of creating a great divide between the Muslim and non-Muslim community of the country ignorantly chose to interpret verses from the Qur’an and traditions of the prophet; in much the same way the four blind men described an Elephant. We are also in the process of producing the correct interpretation of the same as soon as possible. Many of the other ideas expressed at this conference too are extremely upsetting. The All Ceylon Jamiyyathul Ulama is studying these in more detail.

On behalf of the entire Muslim community of Sri Lanka, the All Ceylon Jamiyyathul Ulama humbly requests that the actions of those who insult religions should be immediately brought to an end, and that His Excellency the President and the venerable Maha Sangha should pay immediate attention to this issue.

It has become a global phenomenon for extremists to point the finger of extremism at others, to hide their own nature. We see most of the ideas expressed at this conference as being unconstitutional. Totalitarian Fascism is not an ideology that accepts the existence of any religion. The constitution has ensured the protection of all ethnic groups and religions, and presenting totalitarian fascist ideas to deny those rights, raises serious legal questions. We believe it is now time that all Sri Lankans including the venerable Maha Sangha  and the moderate Sinhalese who form the vast majority of  the population, came together hand in hand to reject such fascist ideologies and create an environment of peace and harmony in our motherland.

BASL seeks expert opinion on MR’s third term

The Bar Association of Sri Lanka (BASL) has sought legal opinion from foreign constitutional experts on whether the Constitution allows President Mahinda Rajapaksa to contest for a third term, a senior member of the BASL said yesterday.

BASL President Upul Jayasuriya said expert legal opinion was extremely vital if anyone was going to challenge the declaration of a presidential election by Elections Commissioner in the wake of the President deciding to call a presidential election and contest for a third term before completing his full term of six years which ends in November 2016.

Speculation is rife that President Rajapaksa was mulling the idea to call for a presidential election after completing four years of his term on November 19 this year. Under the Constitution a President is entitled to call for a presidential election after completing four years of his or term of office.

“Yes, we have sought legal opinion from a Professor of the Constitutional Law in a foreign university on the constitutionality of President Rajapaksa contesting for a third time.

“We are awaiting his opinion on this issue to take a final decision on the course of action we should take on this matter,” Mr. Jayasuriya said.

He told Daily Mirror the opinion of Sri Lankan constitutional experts would also be sought before a final decision but did not elaborate on whether the legal action would be a collective act of the BASL or by a team of lawyers challenging the declaration of a presidential election.

“All depends on the opinion of foreign and local constitutional experts and we expect a response from them shortly. However, it is crystal clear the there is a grave constitutional issue here,” Mr. Jayasuriya said.

The doubts about President Rajapaksa’s constitutional rights to contest more than on two occasions developed into a debate in social and political circles and in the media when retired Chief Justice Sarath N. Silva said he would challenge the legality of the President Rajapaksa contesting for a third term.

His contention is that the 18th Amendment to the Constitution was enacted on September 9, 2010 and President Rajapaksa was elected for the second term on January 27, 2010. Therefore, the 18th Amendment does not apply to President Rajapaksa’s Presidency and as a result he cannot contest in a Presidential Election again.

Mr. Silva argued that the 18th Amendment did not have any retrospective effect and was effective only from September 9, 2010 onwards. Article 31 (2) of the Constitution says, “No person who has been twice elected to the office of the President shall be qualified thereafter to be elected as President.”

“He should have removed this clause before taking oaths and implemented the 18th Amendment. He should have made it clear that at the time he takes oath he could contest for the Presidency any number of times. It was a dishonest Amendment to the Constitution,” Mr. Silva declared in an interview given to Daily Mirror in July.

Casinos in ‘Port City’

It is revealed that casino project is the main aspect of the construction of the Colombo Port City Project that was launched by Chinese President Xi Jinping and President Mahinda Rajapaksa on the17th.  The budget is estimated to be Rs.1950 billion.

The video released by the organizers of the project to advertise Colombo Port City reveals the scheme. It reveals that, among other entertainment facilities, casino centers would be constructed in the ‘city’.

President Mahinda Rajapaksa’s government had on numerous occasions stated that no casinos would be allowed to be built in the country. Political parties, Maha Sangha and different mass organizations have opposed the move to make the country a gambling den.

MCSL Raises Concerns Over Gnanasara’s Threats

The Mulim Council of Sri Lanka (MCSL) has raised concerns over the explicit threats that have been levelled against their organisation by the General Secretary of the  Bodu Bala Sena (BBS) during the convention of Buddhist monks that was held this Sunday.

MCSL Vice PresidentHilmy Ahamed, in a letter to President Rajapaksahas written that during the convention held on Sunday at the Sugathadasa Stadium, the controversial monk had made public threats against the MCSL stating that the organisation would be ‘taken care of’ following the conclusion of the event and has urged the President to intervene against the intimidation and threats posed by BBS and other extremist organisations.

He has pointed out that it is this type of rhetoric that would tarnish the good name of Sri Lanka in the international arena and goes on to state that they are raising concern overGnanasara‘s comments not simply as Muslims but as concerned citizens of this country.

Commenting on the context in which Gnanasara had made this threat, the MCSL has stated that they along with several other Muslim organisations raised concerns over the visit of controversial Burmese monk Ashin Wirathu due to his sermons that led to the massacre of thousands of Burmese Muslims. Ahamed has pointed out that it was not simply them and even a number of government ministers including AHM Fouzie, Rauff Hakeem, Rishard Bathiudeen and Faizer Mustapha too had objected to the visit of Wirathu.

Against the backdrop of the anti-Muslim sentiments that have been propagated by certain extremist Buddhist monks, the MCSL states they were concerned of the possibility of Wirathu’s visit disrupting the peaceful coexistence between religion and ethnic communities in the country.

“We were also concerned of his visit further contributing to the allegations on human rights violations directed towards Sri Lanka,” he has noted.

While noting the manner in which Gnanasara has managed to remain unpunished by law despite his virulent speeches and misquotation and blasphemous comments regarding the Quaran that has resulted in a propagation of hatred against Muslims, Ahamed has noted that they have taken all possible steps to address such actions such as the ongoing case at the Colombo Magistrate Courts and the complaint that has been made at the Religious Police division at the Ministry of Buddha Sasana against the Gnanasara’s comments.

Government plays down views of BBS

The Government today played down the views expressed by the Bodu Bala Sena (BBS) and insisted that it stands for coexistence among all communities.

Cabinet spokesman, Minister Keheliya Rambukwella said that the Government did not endorse the views of the BBS expressed at a conference in Colombo recently.

He also said that if anyone felt threatened by the views expressed by any group or individual then there is a legal system in place where the concerns on such issues can be addressed.

The Cabinet had also today approved the appointment of a Cabinet Sub-Committee on Social Reconciliation and Coexistence among Communities.

The Cabinet Sub-Committee on Social Reconciliation and Coexistence among Communities will be presided over by President Mahinda Rajapaksa and will comprise of Ministers to monitor and facilitate the implementation of the Lessons Learned and Reconciliation Commission (LLRC) recommendations aimed at strengthening of coexistence among communities.

The Cabinet has also agreed to appoint a Committee of Officers comprising of Ministry Secretaries and presided over by the Secretary to the President who functions as the Chairman of the Committee which supervises the implementation of the recommendations of LLRC to assist this Cabinet Sub-Committee.

The BBS on Sunday issued an ultimatum to the Government, saying it will not hesitate to push for a change of Government if the Government fails to address, what he claims to be, a threat faced by Buddhism in Sri Lanka.

BBS President, the venerable Kirama Wimalajothi, speaking at a BBS conference at the Sugadathasa indoor stadium, insisted that Sri Lanka is not a multi-religious country.

He said Sri Lanka is a Sinhalese, Buddhist country and Buddhism in Sri Lanka is now facing a threat from some groups, including according to him, extremist Muslim and Christian groups.

Speaking in front of a large gathering of monks and guests, including the venerable Ashin Wirathu, the dreaded leader of the 969 Movement in Myanmar and the Vedda chief, the venerable Kirama Wimalajothi said that a BBS policy statement will be presented to the Government detailing the concerns of Buddhists in Sri Lanka and if the Government fails to address the issue then the BBS and Buddhists in Sri Lanka will “bring a man from the village” to lead the country and make the change. (Colombo Gazette)

(Lanka-e-News- 30.Sep.2014, 6.30PM) Believe it or not ! a deadly lethal company against which a court injunction order lasting nearly two months was issued for continuous pollution of the environment of Sri Lanka (SL) had been awarded a gold medal on the 27 th (Saturday) by the National chamber of exporters SL, according to reports reaching Lanka e news.

While the export companies that are operating lawfully have been shocked beyond belief by this award given to this lethal company that is a sole cause of grief and disaster to the people , and had been subject to a court injunction order, Lanka e news too had exposed this company on many occasions . This company is none other than the notorious Norwegian company ‘Jiffy products SL Pvt. Ltd.’

This deadly Co. which exports fiber uses calcium nitrate that has been prohibited now by the Coconut development board , to clean the fiber. In addition this Co. has been secretly sending the contaminated toxic water into the Deduru Oya, thereby monumentally polluting the environment. While this treacherous and lethal action of Jiffy Co. was getting exposed , what the Company did was : after oiling the palms of the Wayambe chief Minister Dayasiri Jayasekera and the provincial environment authority chief , both of whom are well noted for their venal obsessions, suppressed the disaster. What’s more ? injunction orders were obtained against the 5 media Institutes which revealed the true dangers . Lanka e news however , which gives priority to the larger interests of the nation did not care two hoots for that order, and unrelentingly continued to expose the deadly and dangerous activities of this Co.

Subsequently , the residents who formed the ‘Deduru Oya protection organization’ filed an action in Nikaweratiya courts on the grounds that toxic water is being drained into the Deduru oya , and the grave harm it is causing to them. Following this action , the Nikaweratiya district judge Ms. D.M. Kodituwakku issued an injunction order against the Jiffy Co. on 7 th August under section 98 of the criminal procedure code.

When this case No. 21490 /PC was called up again on 19 th August , after hearing the evidence of the three witnesses of the petitioners , much to the relief of the residents , the injunction order was extended for a further period .

It is therefore significant to note that Jiffy Co. is still subject to the injunction order. Despite it if the gold medal is awarded to this company , it is simply because corruption breeds corruption. Based on the criteria that should be actually followed by the SL national export development board when giving awards , this award to Jiffy Co. is absolutely illegal., because when awards are being given , it must be taken into account what steps the Industry has taken to protect the environment , which is a most important criterion. In the circumstances , this award to a Company that has acted unlawfully , destroyed the environment and tainted by a court order against it is the joke of the century , and a display of the corrupt nature of the awards ceremony , under estimating the other award winners too.
